INDIA: A dental visit turned into a nightmare for KR Usha Kumari, a resident of Kottayam, Kerala, as she sought recourse for a dental procedure gone awry. Kumari filed a complaint against Dentist Shiny Antony Rauf, accusing the dentist of performing an unauthorized procedure on five healthy teeth without her consent.
Mental and Physical Agony
The unauthorized dental procedure left Kumari in excruciating pain, impairing her ability to speak and causing significant distress. Subsequently, Kumari incurred further expenses seeking treatment at Kottayam Dental College and another hospital to rectify the damage, including paying Rs 57,600 (US$433) for the corrective procedure.
Verdict by the Consumer Forum
The District Consumer Forum in Kottayam District found merit in Kumari’s complaint, ruling that the dentist’s negligence had caused significant harm. The forum ordered Dr. Shiny Antony Rauf to pay a compensation of Rs 5 lakh (US$ 6,025)to Kumari, acknowledging the mental anguish and financial losses incurred due to the botched dental procedure.
Precedent of Medical Negligence
This case adds to a growing body of litigation highlighting medical malpractice and negligence. In a recent Supreme Court ruling, an 84-year-old man from Faridabad was awarded Rs 2 lakhs in compensation for losing vision in his left eye during a surgical procedure conducted in 2002. The apex court upheld the verdict of the Faridabad District Consumer Disputes Redressal Commission, underscoring the repercussions of medical negligence on patients’ lives.
Conclusion
These cases underscore the importance of accountability and patient welfare in medical and dental practice. The rulings serve as a reminder to healthcare professionals to prioritize patient safety and consent, ensuring that medical procedures are conducted with the utmost care and diligence to prevent unnecessary harm and suffering.
