GERMANY: medmix, a prominent player in high-precision delivery devices for the dental sector, has achieved a significant legal victory in a patent infringement case against the Kettenbach/Xinial dental mixing system.
The Düsseldorf Higher Regional Court (OLG Düsseldorf) recently ruled in favor of medmix, affirming that the Kettenbach/Xinial system infringes upon medmix’s European Patent EP2485852B1.
Enforceable Injunction Issued
The judgment, announced on February 1, 2024, entails a provisional enforceable injunction against Kettenbach GmbH & Co. KG and XINIAL Systems GmbH & Co. KG, prohibiting them from manufacturing, offering, or selling the infringing dental mixing system in or from Germany.
Additionally, the court mandated Kettenbach/Xinial to provide a detailed account of the infringing acts, recall the products from commercial customers, and destroy the infringing items in their possession.
Despite the court’s decision, Kettenbach/Xinial has lodged a complaint against the denial of leave to appeal. However, an appeal on points of law was not permitted by the Düsseldorf court. Furthermore, medmix’s European Patent EP2485852B1’s validity has been upheld by the European Patent Office and the German Federal Patent Court.
Ongoing Litigation in the US
In addition to the German case, medmix has initiated legal action in New York against Kettenbach/Xinial, addressing false advertising and trademark infringement claims. The trial is anticipated to commence in early 2025. Meanwhile, Xinial has filed an invalidity case against medmix’s US patent at the US Patent and Trademark Office, which is subject to an ongoing appeal by medmix.
