Zest Dental Solutions Files Complaint Against Biomet 3i for Unauthorized Use of Trademarked Colors

Zest Dental Solutions has recently filed a complaint in the Supreme Court of the State of New York, accusing Biomet 3i, also known as ZimVie, of breaching a former distribution agreement. The complaint alleges that ZimVie violated the agreement by utilizing Zest’s trademarked LOCATOR retention insert colors without permission.

Retention Inserts with Trademarked Colours

According to the complaint, ZimVie developed retention inserts with identical colors to those trademarked by Zest, including blue, pink, clear, red, orange, green, and gray. These actions allegedly took place during the term of the agreement, without Zest’s knowledge or authorization.

The complaint further claims that ZimVie continued to employ Zest’s trademarked colors for marketing retention inserts even after the termination of the distribution agreement. Zest asserts that ZimVie’s use of these colors is unauthorized, and ZimVie is not an authorized seller of authentic Zest LOCATOR products. In the complaint, Zest seeks both monetary and other forms of relief in response to the alleged breaches. 

Statement from Zest Dental Solutions CEO

Zest Dental Solutions‘ CEO, Tom Stratton, expressed disapproval of ZimVie‘s unauthorized use of Zest’s iconic LOCATOR insert colors. 

“Zest firmly believes that ZimVie’s secret development and subsequent marketing of retention inserts using Zest’s colors breach ZimVie’s contractual obligations to Zest,” said Stratton. 

“The complaint filed against ZimVie today represents Zest’s first step in enforcing those obligations. As always, Zest will vigorously defend its contractual and intellectual property rights.”
